What can he be accused of?
In 2016, porn star Stormy Daniels alleged that she had sex with Donald Trump in 2006 and that the then-presidential candidate’s staff — including his lawyer, Michael Cohen — had bought her silence for $130,000 — before the election – so as not to reveal details of their private moments.
This is not illegal – it is a private agreement and transaction. However, when Mr. Trump paid Mr. Cohen, the payment receipt said it was for legal fees. Prosecutors say that amounts to falsifying business records, which is a misdemeanor — a criminal offense — in New York.
The conviction for misdemeanor would simply incur a fine.
In a worst-case scenario, prosecutors could allege that Daniels’ financing violates election law.

New York prosecutors believe it was a bribe to influence the outcome of the presidential election by concealing embarrassing information about Trump, and thus a hidden donation to the president’s campaign, in violation of campaign finance laws.
