A large and angry debate has opened in the US after the tragic death of a one-year-old babywhich – while they existed strong evidence that his parents were abusing him and Providence had given him to a foster family (along with her 2-year-old brother) – a Brooklyn judge ruled that the child is not in danger and “returned” it to the parents.

Little Ella Vitalis was given to her parents28-year-old Johnson Vitalis and 29-year-old Lafeyette Browne, on September 14 and a day later, she was again taken unconscious to the hospital.

The doctors detected bruises and cuts on her forehead, a swollen eyelid, bite marks and broken jawamong other injuries, according to the court documents, which include court reports and Administration for Children’s Services records.

The baby was admitted to intensive care with a fractured skull and brain bleeding and the little girl eventually died 5 days later on September 20th.

The baby’s mother told authorities that Ella began choking while her father was feeding her. She attributed her injuries – including bruises, cuts and a head injury – to Ella drinking too much milk.

According to the NYT, police are investigating the baby’s death as a homicide, but have yet to make any arrests.

Providence had removed the children from home

Since last June, Ella and her brother, Liam, by a decision of Welfare which had established abuse, had been removed from their parents and assigned to a foster family.

Yes, the first complaint it was done last year in August, when the little girl was just 3 weeks old. At the time, the parents had taken both children to the hospital after a call was made to the police reporting domestic violence.

Doctors who examined the children found that Liam had no injuries, but Ella had two broken anklesone skull fracture and a small one brain haemorrhage.

In September – while Ella was still in foster care and before the judge’s fatal decision – she was admitted to hospital with “trauma to the tongue” and could not eat for six days.

The baby was “injured” when his father visited – as provided for in the decision of Pronia. The foster mother left them alone and when she returned she found Ella with a cut and bleeding tongue and took her to the hospital.

The father said the 11-month-old scratched her mouth. But the doctor who examined her found that a sharp object must have been used for this wound.
