“The Colorado Supreme Court issued a completely problematic decision tonight, and we will quickly appeal to the US Supreme Court and ask that this profoundly undemocratic decision be stayed,” Stephen Chang said in a press release.
A spokesman for former President Donald Trump denounced the “undemocratic” decision made by the Colorado Supreme Court on Tuesday, ruling that the Republican is ineligible to run for the highest office in the United States because of his actions on January 6, 2021, the day that his followers attacked the Capitol.
“The Colorado Supreme Court issued a completely problematic decision tonight, and we will quickly appeal to the US Supreme Court and ask that this profoundly undemocratic decision be stayed,” Stephen Chang said in a press release.
Colorado’s top court ruled in a narrow 4-3 decision that the Republican is ineligible to run for president, ordering his name removed from the ballot ahead of the state’s GOP process. for the nomination of their candidate in the presidential elections of November 2024. He ruled that Article 3 of the 14th Amendment of the Constitution is applicable in the case of the former president.
Carlos Samur, a dissenting member of the Colorado Supreme Court, said in a lengthy opinion that the case was not a “fair” mechanism for deciding whether Mr. Trump should be disqualified since he has not been convicted of treason by justice, consequently he is also denied the right to a fair trial for the events of January 6.
“Even if we’re convinced that a candidate has committed atrocious acts in the past — even if he’s engaged in sedition, I dare say — due process must be followed before we can rule that person ineligible for election,” the judge explained.
Donald Trump is the first presidential candidate in American history to be ruled ineligible to run by a court under this rarely used amendment.
A lawyer for the Republican argued in the Colorado Supreme Court that the events at the Capitol were not serious enough to be called a riot or standoff, that the former president’s speech to supporters in Washington before the attack was protected by his right to free speech, which is constitutionally protected, and that the court had no jurisdiction to deny Mr. Trump, who has a huge lead in the GOP polls, the right to run.
On the federal Supreme Court, conservative justices have a decisive majority (6-3); three of its members have been appointed by Donald Trump.
