Donald Trump took office today in favor of granting “full immunity” to the US president, not coincidentally at a time when a Washington appeals court is considering his argument that he enjoys immunity and cannot be prosecuted for trying to overturn the 2020 election.
“A US president should have full immunity, without it he could not properly exercise his duties” and this applies “even to things that cross red lines” he argued in a post, in capital letters, on the platform Truth Social.
Trump, the favorite for the Republican nomination, faces four criminal trials in the following months, and tries with successive appeals to postpone them if possible until after the presidential elections.
In December, the judge presiding over the 2020 election attempt rejected his request for immunity, ruling that no law protects former presidents from criminal prosecution. Trump appealed, and his lawyer, John Sauer, argued in early January before the Court of Appeals that “it would open Pandora’s box” if presidents were allowed to be prosecuted for what they did in the performance of their duties.
When a judge, Florence Penn, asked him whether it was official duty for the president to send in special forces to assassinate a political opponent or to sell presidential favors, John Sauer answered in the affirmative.
The three judges of the Washington Court of Appeals they appeared very cautious against this claim for full immunity. If they reject the request, Trump could appeal to the US Supreme Court.
“God bless the Supreme Court,” Trump added in his tweet today, saying it would be “easy” for the nine justices to rule on the question of presidential immunity.
