The New York Supreme Court on Thursday overturned the 2020 sex crime conviction of former Hollywood producer Harvey Weinstein.

In a 4-3 decision, the state Court of Appeals said the judge erred in allowing prosecutors to include the statements of women who claimed Weinstein assaulted themeven though they were not part of the charges he was facing.

“We conclude that the trial court included testimony of alleged prior sexual acts against persons other than the complainants of the underlying crimes,” the court’s decision said. “There must be a new trial.”

The decisiony state Court of Appeal reopens a painful chapter for the cases involving allegations of sexual harassment by powerful figures in America, which began in 2017 with a flurry of accusations against Weinstein.

A majority of the court said that “it is an abuse of judicial discretion to allow unexamined allegations of misconduct that tarnish a defendant’s character but shed no light on his credibility with respect to the criminal charges brought against him.”

Weinstein, 72, is serving a 23-year sentence in a New York prison following his conviction for sexually assaulting a TV and film production assistant in 2006 and third-degree rape for assaulting an actress in 2013.

He will remain incarcerated because he was convicted in Los Angeles in 2022 of another rape and sentenced to 16 years in prison. Weinstein was acquitted in Los Angeles of the charges involving one of the women who testified in New York.
