“As a result of the election held on November 5, 2024, the defendant, Donald Trump, will be sworn in as President on January 20, 2025,” Smith wrote in his letter. “It has long been the position of the Department of Justice that the United States Constitution prohibits the federal indictment and subsequent criminal prosecution of a sitting President. This result is not based on the merits or strength of the case against the defendant,” Smith stressed in the six-page filing.
In a statement, Trump’s team said the move to end the case was “an important victory for the rule of law.”
“The American people re-elected President Trump with an overwhelming mandate to make America great again,” said Trump spokesman Steven Chung.
Trump’s return to the White House has brought many of the criminal cases against him to a standstill. His sentencing in the Stormy Daniels money laundering case has been postponed indefinitelywhile another federal case related to the handling of classified documents, which he had moved to his Mar a Lago home, is also likely to be dismissed as he takes office.
