Analyst waits almost ten years for review, but INSS delays payment

by

Logistics analyst Thadeu dos Santos Lista, 31, says that, in March 2013, he received a letter from the INSS (National Institute of Social Security) confirming his right to the values of the revision of article 29, also known as revision of aids.

In the correspondence, the agency informed that the payment would only be made in May 2022. But after almost ten years of waiting, Santos still has not been able to access the amounts, even after the INSS released the last batch of the review, between the 2nd and May 6th.

“This is a benefit that has been foreseen for almost a decade, that is, minimally programmed. Thus, it is not acceptable not to meet deadlines and not receive a satisfactory return”, says the reader.

The last batch of arrears from the review of aid includes citizens who, in April 2012, were up to 45 years old, no longer received the benefit calculated with error and had arrears from R$ 6,000.01. The INSS reported that it paid the amounts to 10,491 beneficiaries, but the reader did not receive them.

This review is due because, between 2002 and 2009, workers had disability benefits calculated at 100% of contributions, but the correct thing, at the time, would be to have discarded the lower 20% to define the average salary. They are entitled to sick pay, disability pensions and death pensions derived from disability benefits.

The INSS had to pay this review automatically (without the need for the insured to make the request) after a court agreement signed between the institute, the Federal Public Ministry and the National Union of Retirees, in 2012, ten years ago. At the time, after a public civil action, the government defined a calendar with annual installments of arrears payments.

Without receiving the benefit on the scheduled date, the reader sought the report of Sheet. Initially, the INSS informed, through its advisory in Rio de Janeiro, that the money would be deposited within seven working days, a deadline that would end on May 26.

The reader consulted Meu INSS on the new date set by the agency, but said that the payment was still “under analysis”. When contacted again, the institute informed that the money would fall into the account until May 31.

The payment was deposited, but the reader states that he has not yet been able to get the money from the bank and goes to another step in search of the arrears. “Now, next week, I’ll return to the agency to look for new alternatives. I’m still looking for my right.”
