Panel SA: Public Ministry investigates ban on cell phones in airport boarding queues

The Federal Public Ministry of Campinas and Region opened an investigation to investigate the ban on cell phone use in the boarding line at Viracopos International Airport.

The case unfolded from the complaint of a passenger who claims he was waiting to board an international flight when an airline employee reprimanded him for using the device.

He says he questioned the ban, and the official said he was following instructions from the Federal Police, which confirmed the ban.

With the prosecutor’s refusal to proceed with the complaint, the passenger filed an appeal defending the illegality of the ban and the collective nature of the violated right.

Rapporteur Geisa de Assis Rodrigues, from the Regional Attorney’s Office, concluded that it is necessary to investigate whether there was illegal action by Federal Police agents and airline employees.

“There is no rule in the legal system that makes it impossible to use a cell phone at the country’s airports when the passenger is in the boarding line and during the stay on the aircraft access finger”, says lawyer Gabriel de Britto Silva, specialized in consumer and aeronautical law.
