INSS will reactivate suspended BPC in 30 days; know how to order

The INSS (Instituto Nacional do Seguro Social) created rules and a specific task in Meu INSS to meet requests for reactivation of BPC (Benefício de Prestação Continuada) suspended or blocked due to lack of updating in CadÚnico (Cadastro Único). The period for the institute’s server to respond to the request and regularize the situation is 30 days.

CadÚnico is the federal registry that contains information on income and social status of citizens and families in situations of vulnerability. Being in it is one of the conditions to be entitled to the BPC, which pays a minimum wage (R$ 1,212) to citizens who have never contributed to the INSS, but have an income of up to a quarter of the minimum per person in the family (R$ 303 this year ) and are elderly or disabled.

The new rules for the reactivation of the BPC and the 30-day period for the regularization of the request are in ordinance 1022, published earlier this month. According to the document, the reactivation of the benefit must be requested remotely, by telephone 135, or at the Social Security agencies.

At Central 135, which operates from Monday to Saturday, from 7 am to 10 pm, the insured will have to inform that it is a request for reactivation of BPC after updating the CadÚnico data. If you want a face-to-face service, you will have to schedule a trip to an agency, by phone or 135 or on Meu INSS. In this case, the insured must inform that he wants to schedule a “specific service”.

According to the ordinance, for all cases, the task of “BPC Reactivation after CadÚnico update” will be created. When this procedure is opened, the server has 30 days to respond to the insured’s request, updating the Cnis (National Registry of Social Information) with the information from the Single Registry.

In a note, the INSS informs that it is also possible to reactivate through Meu INSS. To do so, the insured must first look for a Cras (Social Assistance Reference Center) and then access My INSS and request the “Reactivate Benefit” service.

Review takes place every two years

According to lawyer Roberto de Carvalho Santos, president of Ieprev (Institute of Social Security Studies), the BPC is a benefit that is reviewed every two years, which can be suspended or blocked due to failure to update the insured’s data in CadÚnico.

In these cases, the citizen must regularize the situation in a Cras and then inform the INSS that their data is up to date on the federal list. If you do not perform this procedure, the benefit may be terminated. To get the income again, you will need to apply for a new BPC.

“Before, there was no procedure, so you updated CadÚnico because your BPC was canceled and called 135, but there was no such task and regularization of the BPC. Often, the insured lost his income”, says Santos, remembering that, before to cancel a benefit, the INSS must give the citizen the right to ample defense.

“The ordinance adopts a procedure in relation to the reactivation of the benefit terminated by not updating the CadÚnico”, says Adriane Bramante, of the president of the IBDP (Brazilian Institute of Social Security Law).

How to know if it is necessary to update the data in CadÚnico?

Citizens who need to update their data on CadÚnico are being warned by the government of the return of the registration review, after two years stopped in the pandemic. They receive a message at home, through the Post Office, or at the time they are going to withdraw the benefit.

The review resumed from the second half of May and should reach about 8 million citizens who receive assistance benefits from the federal government.

Rômulo Saraiva, social security lawyer and columnist for Sheetstates that the beneficiary needs to be aware of his registration in some way, because, in the ordinance itself, the INSS admits that there are errors on the part of the servers that result in a cut in income.

“In Article 9 [da portaria] it is exposed that the INSS has unduly terminated BPC, to the point that the cut was mentioned before the deadline, which is absurd”, he says.

In a note, the INSS informs that there are 982 benefits suspended due to lack of updating of CadÚnico. In May, there were 5,500. There are, today, 4.7 million citizens with the BPC with duly updated registration. The agency also clarifies that the blocked benefit is no longer paid for only one competence. Suspension is a process that prevents the generation of any credit on behalf of the insured.
