Government sanctions law authorizing airlines to ban unruly passengers

Episodes of confusion and indiscipline carried out by passengers of Brazilian airlines may be about to end. With the approval of the Simple Flight Law, sanctioned this Wednesday (15) by the federal government, companies are authorized to ban passengers who get excited, break rules and cause riot on board.

The measure, which already exists in the US and European countries, was expected in Brazil, where denial of service is not allowed.

According to article 232 of the Simple Flight Law, the civil aviation authority is responsible for regulating the treatment to be given to undisciplined passengers, including in relation to the appropriate measures.

Among the consequences, the passenger may be banned from flying by the company for up to one year. “The air service provider may stop selling, for up to 12 months, a ticket to a passenger who has practiced an act of indiscipline considered very serious”, says an excerpt from the legislation.

However, the criteria for the punishment have not yet been disclosed. The punishment does not apply to the passenger who is on a State mission.

Also according to the legislation, the data of the passenger who has practiced indiscipline considered very serious may be shared with other airlines. That is, if the passenger interferes with an airline’s flight, he may not travel with the company and its competitors for a period of one year.

LAW NEEDS TO BE REGULATED

The Simple Flight Law still needs to be regulated by Anac (National Civil Aviation Agency). The text is expected to be published in the coming months.

In addition to being unable to travel by companies in Brazil, the punishment could apply to foreign companies that, depending on where they are based, can adopt the Brazilian list.

During the pandemic, the most recurrent episodes of indiscipline among passengers involved the mandatory use of a face protection mask. In Brazil and in other countries around the world, the use of protection became mandatory by law or by determination of the aircraft operators.
