The toll price freeze announced by governor and reelection candidate Rodrigo Garcia (PSDB) last week should open a confrontation with highway concessionaires in the coming months. After announcing that they are considering going to court against the measure through ABCR (the sectoral association that represents them), the companies raised their tone and began to communicate to their shareholders that they intend to react to the government.
According to the contracts in force, new tariffs would begin to be charged on July 1st and the readjustments would be 10.72%, for those linked to the IGP-M, and 11.73%, for those adjusted by the IPCA.
When it warned companies that the increase would be frozen, the sector’s regulatory agency, Artesp, informed that “it will study ways to promote contractual solutions to be implemented in the next few days, in order to mitigate any imbalance”.
Ecorodovias, responsible for the Imigrantes and Ecopistas systems (which includes the Ayrton Senna and Carvalho Pinto highways), said in a statement to its shareholders that it will monitor the measures taken by the government and that “it will analyze the necessary measures to protect their rights and ensure the compliance with concession contracts.”
Administrator of the Anhanguera-Bandeirantes system, CCR told its shareholders that it expects the government of São Paulo to respect the law and the concession agreement in force. If such compensatory measure does not come out, “the company will adopt the appropriate measures to guarantee the application of the contractually established rights.”
Rodovias do Tietê, which is in the process of judicial recovery, and Rodovias das Colinas also informed that they will analyze appropriate measures.
Arteris, which manages ViaPaulista and Intervias, a system that operates in 20 cities in the interior of São Paulo, said in a statement that it urgently awaits action. To the shareholders, he said that compensatory measures will be necessary to “avoid risks to the execution of works and services.”
