Panel SA: Action in the STF against the nursing floor receives reinforcement from new entities

Amid pressure from the health sector against the law that established the new floor of nursing in Brazil, another entity, the APCCAA (association to combat cancer in Piauí), asked to join as an amicus curiae (interested in the cause) in a action that requests the unconstitutionality of the subject in the STF (Supreme Federal Court).

In addition to the association of Piauí, the ADI (Direct Action of Unconstitutionality), which was proposed by the CNSaúde (National Confederation of Health), has already received support from entities such as Santas Casas, philanthropic hospitals and dialysis centers.

In the request filed this Thursday (18), the APCCAA states that it is a non-profit institution that provides services to the SUS and that it treats almost 100% of adults and children with cancer in Piauí.

The São Marcos hospital, one of the APCCAA’s support arms, is remunerated by the SUS table, and the institution says that prices have not been updated for 17 years, contributing to deepening the financial deficit. Allied to this, the advances of inflation in the sector and the rise of the dollar increased the financial mismatch of the hospital.

According to the entity’s accounts, the monthly budget impact of the new nursing floor will be R$ 1.3 million, a calculation made without taking into account indirect adjustments that will be necessary to adapt the salary policy, says the APCCAA in the request to the STF.

“The philanthropic institutions and in this specific case the APCCAA – maintainer of Hospital São Marcos, already in a situation of financial deficit, as they do not have the means to bear the immediate costs arising from the law in question, are forced to reduce their staff or, in the worst case, close its activities”, says the entity.
