Retirees, pensioners and other beneficiaries who defeated the INSS (National Social Security Institute) in actions of up to 60 minimum wages in court and had the payment order issued by the judge in July will receive the amounts from next week.
The CJF (Council of Federal Justice) released to the TRFs (Regional Federal Courts) R$ 1.7 billion for payment of RPVs (Requisitions of Small Value) assessed last month. RPVs are delayed up to R$72,720.
Of the total, R$ 1.4 billion will be paid to INSS policyholders. In all, 93,241 citizens who won 72,751 cases against the body will benefit.
The actions are for granting or reviewing social security, assistance and disability benefits, such as retirement, pension for death, sick pay or BPC (Continued Provision Benefit). Whoever had the payment order issued by the judge in July receives this month or August.
The process must have come to an end, without any possibility of appeal by the INSS.
How is the payment of RPVs?
The money is deposited in an account opened at Banco do Brasil or Caixa Econômica Federal in the name of the insured or his lawyer. To find out if you will have the values, it is necessary to consult the website of the TRF responsible for the payment.
To know if you will receive this batch, it is necessary to observe the month that appears in the “Date TRF protocol” field. After payment, “payment in full to court” will appear.
Prices will be released from next week.
Once the money is released by the CJF, the date for payment of arrears depends on the schedule of each federal court. In the TRF-3 (Federal Regional Court of the 3rd Region), the forecast is that the money will be made available next week.
According to the agency, the amounts are in the processing phase. Then, there will be the opening of accounts, updating of systems and communication to the courts to then release the withdrawal to the beneficiaries.
At the TRF-5 (Federal Regional Court of the 5th Region), which serves part of the Northeast states, the deposited amounts of RPVs assessed in July 2022 will be available from the sixth business day of September.
At TRF-2, which serves Rio de Janeiro and EspÃrito Santo, the forecast is to release the money from the fifth business day of September.
The TRF-4, responsible for Paraná, Santa Catarina and Rio Grande do Sul, informs that the court does not yet have a payment date.
Understand the difference between precatories and RPVs
Both precatories and RPVs are debts of the federal government in court. The difference between them is the value of the cause. When the action is up to 60 minimum wages, which gives R$ 72,720 this year, the payment is made by RPV, which is a Small Value Requisition.
This type of arrears is generally paid within two months of the judge’s payment order, when the case is fully completed.
Precatórios are actions above 60 minimum wages, paid once a year. This year until 2026, constitutional amendment 114 is in effect, which limited the release of precatories to fund AuxÃlio Brasil.
With this, the federal government released only part of the amounts in 2022. The other creditors will have to wait to receive in the coming years. Payments start in August and end in September.
