SEESP (Nurses Union in São Paulo) says it has registered complaints from workers who have not yet received the new salary floor established in the law sanctioned by Bolsonaro at the beginning of the month.
According to the CNSaúde (employers’ union), the hospitals are in the process of restructuring their budgets and are awaiting the decision of the ADI (Direct Action of Unconstitutionality) taken to the STF (Federal Supreme Court) to contest the new floor of R$ 4,750.
The entity says that the law that applies the nursing floor does not indicate funding for the more than R$ 17 billion that will be added to the salary sheets of hospitals per year, which could cause layoffs and bed closures, especially for philanthropic entities.
Solange Caetano, secretary general of SEESP, says she will file a complaint with the MPT [Ministério Público do Trabalho]. “If necessary, we will file a lawsuit against the hospitals, as we understand that compliance with the law is immediate”, says Caetano.
The case being analyzed by the Supreme Court will be judged by Minister Luís Roberto Barroso. During the month he asked for a manifestation of Congress, the Planalto Palace, the AGU (Advocacy General of the Republic) and the PGR (Attorney General’s Office) on the ADI. All the opinions were against the arguments of the CNSaúde, with the exception of the PGR, which should manifest itself by the end of this week.
ADI already has the support of several associations and employers linked to hospitals, all asking to act as amicus curiae (interested in the cause).
