Chamber approves creation of lotteries for health and tourism, which can be granted to companies

The Chamber of Deputies approved this Tuesday (30) a project that creates health and tourism lotteries with resources destined for the National Health Fund and Embratur (Brazilian agency for the international promotion of tourism), respectively, and with the possibility of exploitation of these new games by the private sector.

The text was approved by 267 to 94. The deputies rejected changes and, now, the proposal goes to the sanction of President Jair Bolsonaro (PL).

The Chamber accepted changes made by the senators to the text of deputies Captain Wagner (União Brasil-CE) and Guilherme Mussi (PP-SP).

The project, approved by the Chamber in May 2021, provided for the creation of the Health Lottery and the Tourism Lottery in the numerical prognosis modality (as is the Mega-Sena).

The senators included two other modalities: sports predictions and fixed-odds betting (when the player already knows how much he can win). This Tuesday, the deputies maintained the change.

In the Senate, the bill also included the possibility that the new lotteries could be granted to the private sector — in the Chamber, the Loteria da Saúde and Loteria do Turismo contests would be carried out by Caixa Econômica Federal.

According to the text, the Ministry of Economy will regulate, within 30 days after the publication of the law, the rules for granting the operation of the Health Lottery by the Ministry of Health and of the Tourism Lottery by the Ministry of Tourism.

According to the rapporteur, Giovani Cherini (PL-RS), the wording approved by the Senate and maintained by the deputies also opens the possibility for municipalities to explore lotteries, as well as Santas Casas.

The project provides for a different distribution of the lottery collection depending on the modality. If it is a numerical prognosis, 5% will be allocated to the FNS (National Health Fund), in the Health Lottery, and to Embratur, in the Tourism Lottery. The remaining 95% will be used to cover operating expenses and maintenance.

In the sports predictions and fixed-odds modality, 3.37% would go to FNS and Embratur, depending on the lottery. Sports entities that cede the rights to use the brand, anthem, symbols, etc. to publicize the new games would receive 1.63%, and 95% would be used for funding.

While the public health emergency of national importance caused by Covid-19 lasts, the resources will be used exclusively in programs and actions to prevent and combat the effects of the pandemic, with priority for the acquisition of inputs, materials, vaccines and equipment. They will also be intended to minimize the effects of contagion by Covid-19 and to fight advances of the coronavirus in the tourist sector, in the case of the Tourism Lottery.

The project foresees that the values ​​of the prizes not claimed by the winners of the two lotteries will be reverted, respectively, to the FNS and to Embratur, observing the financial and budgetary programming of the Executive.

The National Health Fund and Embratur should disclose on their websites the application of resources obtained from the Health and Tourism lotteries.
