The Chamber of Deputies approved this Thursday (9) a bill that would amnesty the tax debts of companies that were fined for not complying with the obligation to provide information on the payment of the FTGS (Guarantee Fund for Employees) to the Internal Revenue Service. The proposal goes to sanction.
In practice, the debts of the taxpayer who managed to pay the taxes will be forgiven, but found it difficult to provide information to the tax authorities within the deadline. The measure will benefit all infractions that occurred until the publication of the law.
When he presented the proposal, still in 2014, deputy Laercio Oliveira (PP-SE) argued that the Revenue was fined companies that failed to deliver payment slips for the years 2009 to 2012.
Fines for non-delivery without movement are R$ 200 and for non-delivery with movement are at least R$ 500. According to the congressman, this could make the survival of companies unfeasible, if the charge extended for the five years in which the obligation to deliver the document is no longer fulfilled.
In the Senate, the text underwent changes. One of them determines that the amnesty of fines is valid exclusively for cases in which the guides have been presented with information and without a triggering event for payment of the FGTS.
The final version also makes it clear that the forgiveness of these debts does not imply restitution or compensation for amounts that have already been paid.
