The owner of the company Cerâmica Modelo signed an agreement with the MPT (Ministry of Labor) this Friday (7) after being filmed coercing employees to vote for President Jair Bolsonaro (PL). The case took place in São Miguel do Guamá, Pará, and went viral on social media.
In a video recorded on Tuesday (4), the man promises R$ 200 to employees in case Bolsonaro wins and says that more than half of the companies in the municipality will close if former president Luiz Inácio Lula da Silva ( EN) win the elections.
As part of the TAC (term of adjustment of conduct), the businessman was forced to record a new video apologizing to the employees. He must publish the recording within 48 hours and circulate it widely on WhatsApp.
“I came here, first of all, to apologize to you, who are employees of my company”, he says. “There was an error and I want to tell you the following: I’m here retracting myself. If you stop working for me today and go to work for another entrepreneur, if the entrepreneur does what I did, report it.”
“Go to the Public Prosecutor’s Office. Don’t let me make the same mistake I made. I just made a big mistake. This will not only harm me, but you too. Because your vote is free”, he concludes.
The entrepreneur must also pay compensation of BRL 2,000 to each employee, sign the work card of those who are not registered, provide PPE (personal protective equipment) and pay BRL 150,000 for collective moral damage.
Of the total, R$ 50,000 will be used to fund an awareness campaign on the main radio stations in Pará aimed at entrepreneurs in the state. The remaining amount, R$ 100 thousand, will be directed to social projects to be indicated by the MPT.
“The document also provides that the employer no longer constrains or threatens its employees to vote for any candidates, nor does it incite employers from other economic sectors to do so”, states the Public Ministry of Labor in a note.
“He will also not be able to fire, retain or hire employees on the basis of their party-political orientation.” The businessman was indicted by the Federal Police (PF) for conduct related to electoral crimes and fined by the Labor Tax Audit. In the first video, the man threatened to close down the ceramics activities in the event of Bolsonaro’s defeat. “I’m the only one who has three ceramics here and I’m going to close all three if he [Lula] to win. Because no one will stand the cucumber that comes. Do you understand?”, she said.
“So I have a proposal to make for you here, for everyone. If the president wins the election, each one will have 200 contos in their pockets. Two hundred for each.”
Reports of attempted coercion of an employee must be made directly on the MPT website. It is also possible to formalize complaints through the MPT Ouvidoria application, available on the Play Store, for mobile devices that use the Android operating system.
