Chesf (Companhia Hidro Elétrica do São Francisco), one of Eletrobras’ subsidiary companies, suffered a new judicial defeat last week in a dispute with wind energy companies in Rio Grande do Norte.
Eleven generators sued Chesf to collect losses recorded due to the delay in completing the 230 kV Extremoz II – João Câmara (RN) transmission line.
On Friday (21), the Fifth Civil Class of the TJ-DFT (Court of Justice of the Federal District and Territories) judged appeals again and upheld the sentence that condemned Chesf to indemnify the damages.
When the process began in 2014, the companies said they had spent R$194 million on energy purchases. As they had a supply contract with Cemig and were unable to deliver due to the delay in the works, they had to buy this energy.
According to notices sent by Chesf and Eletrobras to shareholders and the CVM (Securities Commission) on Friday, the updated amount up to June 30 is R$558 million.
The process is classified as “possible risk of loss”. In the communiqués, Eletrobras and Chesf say they are analyzing the decision and its consequences and say it is “certain that it will present the appropriate resources to the judiciary.”
