Workers born in December can make the FGTS birthday withdrawal starting this Thursday

As of this Thursday (1st) workers born in December who opted for the FGTS (Service Time Guarantee Fund) birthday withdrawal can now request the withdrawal of the amount.

The FGTS was created to protect and provide security to workers who are fired without just cause. At the beginning of every month, the employer deposits the equivalent of 8% of the salary of the employee with a formal contract.

The conventional modality of the FGTS is withdrawal-termination, in which the worker dismissed without just cause can withdraw the full amount available in the fund, plus the termination fine paid by the company. In the birthday withdrawal option, introduced in 2019, a portion of the money can be withdrawn in the month in which the worker was born.

The amount released in the worker’s birthday month is available for three months. In this way, in December, the withdrawal of employees born in October and November can still be done. This month’s birthdays have until February to make the move.

How to make the change?

The birthday withdrawal is optional and workers who want to migrate to this system must inform Caixa Econômica Federal, which can be done through the FGTS application.

The return to the conventional modality can be done in the same way, but the law defines that the migration can only be carried out two years after the request for return, that is, the withdrawal-rescission only becomes valid on the first day of the 25th month after requesting the change.

What amount can be withdrawn?

The amount to be withdrawn depends on the total balance that the worker has deposited in the fund, and can vary from 5% to 50% of the amount, plus an additional fixed amount. Upon termination, however, the worker who opts for this modality will only be entitled to the termination fine paid by the employer upon dismissal without just cause.

The withdrawal can be requested through the FGTS application and is available after five working days. Workers who opt for this modality can also withdraw in advance to use it as a guarantee when contracting loans from qualified financial institutions, which charge interest, as they are a line of credit.
