Panel SA: Senator enters dispute of companies in ANS

by

Senator Randolfe Rodrigues (Rede-AP) sent a letter, this Tuesday (7), to the director of ANS (National Supplementary Health Agency), Paulo Rebello, questioning the merger between Rede D’Or and SulAmérica.

One of the members of Lula’s campaign and a frequent figure in the transitional government, Rodrigues wants explanations about the normative basis used by the agency to allow the operation.

The case, in fact, is stopped with a decision contrary to the deal.

In the document, obtained by Panel SA, the senator asked the ANS if Cade (Administrative Council for Economic Defense) participated in the analysis of the case.

The agency approved the operation without restrictions because it did not identify concentration, because SulAmérica sells health plans and Qualicorp, another company from the economic group of Rede D’Or (buyer of SulAmérica), operates in the management of health insurance companies.

For Rodrigues, however, the operation would be an abusive anti-competitive conduct, which would lead the consumer to choose between “eating or paying for a private health plan”.

“There is the maximum verticalization, in that the same operator that sells health plans will be the one that will manage them and also the one that will own the structures for the provision of the necessary services”, says the senator in the letter.

Sought, the ANS and the senator did not respond until the publication of this note.
