Minister wants to ban FGTS birthday withdrawal

The Minister of Labor, Luiz Marinho (PT), will propose to President Luiz Inácio Lula da Silva (PT) to prohibit the birthday withdrawal of the FGTS (Fundo de Garantia do Tempo de Serviço), a modality in which the worker can withdraw part of the balance from your account.

“As a measure to preserve the worker’s savings and guarantee the real purpose of the FGTS, Minister Luiz Marinho will propose to President Lula that the withdrawal of funds from the fund on the anniversary date be prohibited”, says a note from the ministry.

“Before that, he is going to take the discussion of this topic to the FGTS board of trustees and to the trade union centrals.”

The information was initially given by Marinho in an interview with the newspaper O Globo.

The anniversary withdrawal was launched in 2019 as a measure to stimulate consumption in the country. The modality is optional —the worker must expressly make the choice.

Withdrawals are authorized in the month of the worker’s birthday. The lower the balance, the higher the allowed withdrawal percentage. The withdrawal amount varies according to a rate, which ranges from 5% to 50% of the balance. It is also possible to use the birthday withdrawal as collateral to take out loans.

According to the rules, if the worker is dismissed during the validity of the birthday withdrawal, he will receive the termination fine provided for by law, but will not be able to withdraw the residual balances.

Luiz Marinho was confirmed on December 22 to head the Ministry of Labor. In his inauguration, he stated that he will present to the National Congress by May a policy of permanent appreciation of the minimum wage and by the first half of the year a proposal to regulate applications.

The minister also ruled out a complete repeal of the labor reform and the return of the union tax. Marinho stated that he will fully withdraw the Green and Yellow Card project from Congress.

Marinho held the post between 2005 and 2007, when he became Minister of Social Security. In 2008, he left office to run for mayor of São Bernardo do Campo, a city he commanded for two terms.

At the end of December, Marinho held an informal meeting with representatives of trade union centrals and asked for help to recreate bridges with the various sectors in all regions of the country.
