INSS retirees will have a readjustment of 5.93% and the ceiling goes to R$ 7,507.49

INSS (National Social Security Institute) retirees and pensioners with benefits above the minimum wage (from R$ 1,212 until December 31, 2022) will have a readjustment of 5.93% in this year.

The increase also applies to disability benefits, such as sick pay, and will be applied in full to all those who were already receiving their payments on January 1, 2022.

The index is equivalent to the INPC (National Consumer Price Index) recorded from January to December last year and which measures the impact of price changes for families with incomes between one and five minimum wages.

The index was released this Tuesday (10th) by the IBGE (Brazilian Institute of Geography and Statistics) and also corrects the INSS ceiling, which is the maximum value for both social security benefits and contributions paid to Social Security.

Of the current BRL 7,087.22, the ceiling must be BRL 7,507.49 in 2023. According to federal legislation, the benefit readjustment index for retirees and pensioners who receive above the minimum wage is defined by the variation of the INPC of the previous year, but Social Security will still disclose the index and the final value of the ceiling.

For those earning the minimum wage, the new amount was set at R$1,302, but can be readjusted by means of a provisional measure to consider the floor of R$1,320 approved by the National Congress at the end of last year.

According to the INSS, currently 37 million benefits are paid monthly. Almost 70% of beneficiaries receive a minimum wage.

In a few days, the Ministry of Social Security and the INSS should formalize the proportional readjustment percentages, which will be paid to policyholders with benefits granted from February. As these policyholders did not receive 12 months of INSS payments, the percentage of the first adjustment is lower, calculated in relation to the policyholder’s time as a Social Security beneficiary.

INSS benefit with increase

INSS policyholders will start receiving their readjusted benefits from January 25, when those earning the minimum wage have their January payroll deposits. Those who receive more than the minimum amount will have the first benefit with the 5.93% readjustment as of February 1st. The new minimum wage will be paid by the INSS between January 25th and February 7th.

In order to know the exact date of payment, the insured person must consult his benefit number and consider only the penultimate digit – the INSS discards the digit. The benefit number is 10 digits long and appears in the following format: 999,999,999-9.

INSS DELAYS

The new national floor changes the limit used by Justice to pay INSS arrears more quickly to those who won a judicial process for granting or revising the benefit. Considering the floor of BRL 1,302, the maximum amount that can be received through RPVs (Small Value Requisitions) is BRL 78,120, corresponding to 60 minimum wages.

Insured arrears who initiated benefit review actions in Federal Special Courts are entitled. Anyone who takes action in a court waives any amounts exceeding the limit of 60 minimum wages.

Revisions and concessions with values ​​above 60 minimum wages will continue to be paid by Justice through precatories, released in annual batches.

Arrears of up to five years prior to the review request are due, plus the waiting time to receive the increase, if entitled.

CONTRIBUTIONS TO INSS

The 5.93% readjustment registered in the 2022 INPC is also used to update the annual table of social security contributions paid by workers. The government will publish, in the Official Gazette of the Union, the table with the new salary ranges.

As the calculation established by the Social Security reform is progressive, the variation in the minimum wage interferes with the discount for all employees in the private sector. The percentages range from 7.5% (for up to one minimum wage) to 14%, depending on the salary range. Fees are progressive. That is, each percentage applies only to the part of the salary corresponding to each charge range.

For those who pay the INSS on their own and pay according to the minimum wage, the contributions will start to consider the current minimum wage, but the change comes in practice only for payments made from February, as they refer to the January competence.

Policyholders who contribute as optional or self-employed on the floor will have new values, either at the rate of 11% or 20%, also from January.

Low-income housewives, for example, contribute 5% of the minimum wage per month. In 2022, this amount was R$ 60.60. Those who are registered as MEI (Individual Microentrepreneur) may have to pay different amounts, according to the activity carried out.

The basis is also 5% of the minimum wage per month, but those who work with commerce, industry and transport services need to add R$ 1 of ICMS. Services in general contribute with an additional BRL 5. Finally, those who contribute in both sectors are impacted by the incidence of the two taxes, which adds up to BRL 6.

The exception is the MEI truck driver, who must contribute at least 12% of the current minimum wage. ISS and ICMS charges depend on the specifications of the cargo and the scope of the territory in which it travels.

PIS/PASEP ALLOWANCE

The PIS/Pasep salary allowance can be received by workers in private and public companies who earn up to two minimum wages, have worked for at least 30 days in the base year and have been registered with the PIS/Pasep Participation Fund for at least 30 days. at least five years.

The PIS allowance for the year 2021 begins to be paid on February 15th, for those born in January, and has new releases until July 17th, when the payment of the last batch is made, for December birthdays. Two batches are released each month.

The calculation multiplies 1/12 of the minimum wage valid on the payment date by the number of months worked in the corresponding year. In 2023, if the beneficiary worked throughout the reference year, he will receive a minimum salary allowance. If you worked six months in 2021, you will receive half of the current minimum wage.

MINIMUM QUOTE OF UNEMPLOYMENT INSURANCE

The minimum amount of the unemployment insurance installment is also equal to a minimum wage. To calculate the benefit paid to the worker, the government calculates the average of the three salaries prior to dismissal and then applies a reducer, according to the remuneration range.

According to the Ministry of Labor and Social Security, the values ​​will be updated from January 11th. The government also informs that the upper ranges for calculating unemployment insurance will be updated by the 2022 inflation, considering the INPC (National Consumer Price Index).

INTERMITTENT WORK

Under the regime created by the labor reform approved by Congress in the Michel Temer government, in 2017, the employee is paid by the hour and there is no establishment of a minimum shift.

To calculate the intermittent wage, you need to divide the minimum wage by the 220 hours of work per month.
