Panel SA: Government and companies advance in agreement for casting vote in Carf

The debate on the casting vote in CARF (Administrative Council of Tax Appeals) took another step towards the consensus that the economic team has been sewing to try to advance in Congress with the provisional measure that deals with the subject, seen as one of the biggest concerns among the MPs edited so far by Lula.

The text of a possible amendment to modify the MP, which had been discussed with businessmen and tax experts in recent weeks, went to the final version with the PGFN (Attorney General of the National Treasury) this Wednesday (8).

The terms of the agreement are very close to the proposal that had been taken by businessman João Camargo, from the Esfera group, and Abrasca (an association of publicly-held companies that brings together names like Ambev and Americanas).

As Panel SA anticipated, the proposal eliminates the fine and interest, that is, in cases of a tie in Carf, the taxpayer pays only the principal, without monetary correction. What changes in relation to the companies’ first suggestion is the deadline for negotiating the payment, which should be 90 days, instead of 180, as the companies wanted.

After the last adjustments to the draft, the government should deepen the discussion with Congress on the subject, which has already begun. Businessmen from Esfera, who last month even appealed to the presidents of the Chamber and Senate, Arthur Lira and Rodrigo Pacheco, to stop the measure in Congress, now they must retreat with the pressure. On Friday (3), the Esfera group held a dinner in honor of Lira.

The mayor spoke on the subject of the casting vote in Carf this Tuesday (7) and defended a compromise.
