Issuance of Real Estate Tax Certificate (TAP) with the presentation of just two supporting documents (three in the case of non-electrified properties)!

This provides for an amendment of the Ministry of Justice submitted to the Parliament and concerns the simplification of the procedure for the issuance of the TAP certificate, without which a property transfer cannot proceed.

The new regulation provides that in cases of transfer of an electrified property only the following is required:

Photocopy of the latest electricity bill together with its payment certificate

Certificate of Completion of Building Identity/Divided Ownership.

In the event that the property is not electrified, there are three supporting documents:

Power outage certificate from DE.DDI.E with stop date Responsible declaration of the owner for non-use of the property. Certificate of Completion of Building Identity/Divided Ownership.

Without the TAP non-debt certificate, every notarial deed is invalid and has no legal effect.

The certificate is granted at the request of the owner or sought ex officio by the notary public or provided by the transferor.

It is issued within five days based on the data held electronically by the Municipality and is valid until the end of the year of issuance and not for one year from its issuance as defined by the old regime.

The certificate issued by the municipality which can also be in digital form and can be used for the electronic transfer of the property.

The regulation facilitates and speeds up a particularly difficult, bureaucratic and financially “arduous” process for citizens.

The cost could reach up to €10,000 and the issuance of the coveted paper could take up to 10 days from the submission of the application.

The interested party had to have with him:

Last paid electricity bill
Notarial deed of property ownership
Recent floor plan of the property by an engineer
Photocopy of confirmation of settlement of semi-outdoor spaces or arbitrariness
Table of rates or floor plans (originals with engineers’ signatures)

After the physical identification of the citizen, the completeness of the conditions was checked and the file of supporting documentsthen the citizen’s details were registered and his application received a protocol number.

Immediately after that it had to be sent to the competent agency and after its processing the citizen would get the certificate.
