Disabled people can apply for exemption from IPVA 2022 in SP

The Government of the State of São Paulo should release, in the coming days, requests for exemption from IPVA (Tax on the Property of Motor Vehicles) 2022 for owners of vehicles with physical, sensory, intellectual or mental disabilities and people with spectrum disorder. autism.

The request will be made through Sivei (Vehicle System of the Finance and Planning Department), with the password of the Nota Fiscal Paulista program. Anyone who doesn’t have the password can generate it. The driver will have to send the required documentation for the release of the tax payment.

According to the Secretary of State for Finance and Planning, the rule will apply immediately to those who already had the tax exemption in 2020 and 2021, provided that the request is made by July 31. In the case of other owners, the exemption will be released after assessment of the disability condition. The application deadline is also July 31.

Through the portal, the driver must inform the type of disability, the ICD (International Classification of Diseases) and if the person has already benefited from the exemption in previous years. The 2021 exemption requests will be approved in 2022 and the driver should automatically receive the expert report, without having to make a new face-to-face assessment.

For the others, the expert report issued by Imesc (Institute of Social Medicine and Criminology of São Paulo) will be required, necessary to prove the moderate, severe or very serious degree of disability or autism spectrum disorder. To release the report, the institute may request additional documents.

In these cases, official medical reports issued up to three years earlier will be accepted, where the severity of the disability has already been duly proven by a public body.

Those who have already paid the IPVA will have their money refunded.

According to the State Treasury, those who have already paid the IPVA 2022 and prove their right to the exemption will have the money automatically returned, as soon as the request for exemption is accepted by the body. If the request is denied and the owner has not paid the tax, there will be a period of up to 30 days to settle the amounts without charging fines or interest.

In cases of those who do not pay the tax and do not request the exemption, there will also be a period of 30 days to pay the IPVA. In this case, however, interest and penalties will be charged.

Finance data show that, in 2022, there will be 80,800 exemptions for people with active disabilities. Approximately 255 thousand vehicles that had the exemption recognized in 2020 or 2021 by public civil action will have the IPVA 2022 suspended, according to decree 66.470/22 and SFP resolution 05/22.

The secretariat estimates a tax waiver of BRL 705.9 million with the exemptions granted to these drivers in 2022. In 2021, the waiver was BRL 729.8 million, while in 2020, it was BRL 707.9 million.

Documents needed to get the exemption

Among the basic documents required for the exemption request, copies of which must be sent over the internet are: CPF and RG of the person with autism spectrum disorder or with a disability, their tutor or curator, if any, and drivers authorized by the beneficiary for the vehicle.

The Imesc expert report will be another required document. It will also be necessary to send the invoice related to the purchase of the vehicle, in the case of a new car, the leasing agreement, for those who purchased in this modality, the financing agreement, for a financed vehicle, where there is a fiduciary alienation clause in guarantee, in addition to of CRV (Vehicle Registration Certificate), CRLV (Vehicle Registration and Licensing Certificate) and Renavan form (National Vehicle Registration) with vehicle license plate label, if CRV and CRLV have not yet been issued.

IPVA 2022 installments started to expire

Drivers who chose to pay the IPVA 2022 in installments up to five times this year should pay attention to the calendar, as the first installment has already expired. Whoever does not pay in installments or does not pay the total in cash, with a 5% discount, will be in debt with the state and will have difficulties to license the vehicle.

The increase in the number of installments in 2022 took place amid soaring car prices, which increased the value of the tax. According to the São Paulo Treasury, the average increase in the amount of the tax to be paid is 22.54%. It was the first time in ten years that the average amount of the tax had increased.
