European competition authorities are focusing more on companies in the consumer sector, as inflation increases the risk of unfair behaviour. In 2022, competition authorities carried out 17 unannounced inspections across the UK, EU and Switzerland of companies in the consumer goods sector, rising to 26 a year later, according to figures from legal consultancy White & Case.

Competition legal advisers say this is due to concerns that high inflation has made it more likely that businesses will cartel or more successfully hide any anti-competitive behavior in terms of prices, labor practices or consumer rights. “It’s easy to hide price rises when there’s inflationary pressure,” said Zoë Mernick-Levene, head of competition at Leigh Day.
