INSS retirees will receive almost R$ 800 million in arrears

The INSS (National Social Security Institute) retirees who sued the agency and won the lawsuit, without any further possibility of appeal, will receive R$ 792.2 million in RPVs (Small Value Requests) this month.

The money, which corresponds to shares of up to 60 minimum wages —R$ 72,720 this year—, was released this Monday (21) by the CJF (Council of Federal Justice). The amounts refer to cases concluded by the Judiciary and with a payment order granted by the judge in January. This is the first batch of the year that will be based on the value of the new minimum wage, of R$ 1,212 in 2022.

In all, 56,674 policyholders will benefit who won 43,343 lawsuits against the INSS regarding concessions or revisions of retirement, sickness benefits, pensions and other benefits, including assistance such as the BPC (Continued Provision Benefit).

The amount to be paid this month across the country is even greater, as it involves other small claims, totaling R$951.5 million, paid to 95,977 successful beneficiaries in 78,044 cases.

Policyholders in São Paulo and Mato Grosso do Sul, served by the TRF-3 (Federal Regional Court of the 3rd Region), will receive R$ 89.8 million after winning 3,313 lawsuits against the INSS. In all, there are 4,019 beneficiaries.

The consultation to find out how much you will receive is made on the website of each court responsible for the process. In São Paulo, it must be carried out on the TRF-3 website. On the home page, go to “Procedural consultation”, on the right side of the screen, in a green frame, below. Then click on the arrow next to “Process number” and choose the option “Payment requests”.

Then, go to “Consultations by OAB, Process of origin, Requisitioning Office of origin or Protocol number” and enter your CPF, OAB of the lawyer or the case number and click on “I’m not a robot”. Then go to “Search”; then your RPV will appear.

To know if you will receive this month, it is necessary to observe the dates. RPVs whose “TRF protocol date” is some day of January 2021 are paid in February. After payment, “Total payment to the court” will appear. The money will fall into the account opened by the court at Banco do Brasil or Caixa Econômica Federal.

The account opening phase is called processing. In general, the court takes about a week to make the payment.
