Slow “Tembo” is moving the process of legalizing the public abuses: the relevant electronic platform continues to welcome applications, but so far there are few requests that have been filed and even less those that have progressed to the next stage. Of course, interested parties still have time in front of them to make their move, but they should know that some are needed … rather time -consuming bureaucratic processes.

In any case – and with the state preferring once again taxpayer logical measure to resolve an issue that is late – the road to acquisition of immovable property, which is recorded in private property but hold them for a long time. , is open.

The procedure for submitting an application

Applications for the acquisition of real estate are implemented through integrated information system “Applications for the acquisition of public real estate”.

Applications for the acquisition of the landmarks, as well as all relevant procedures and the communication of applicants with the competent services are carried out exclusively through a digital platform.

Applicants are entrusted with Taxisnet codes, and it is also possible to submit the redemption application by an authorized person, who must complete the system of VAT. of and attach a responsible statement of authorization by Gov.gr or with a genuine signature certificate
Access to the Integrated Information System is through Gov.gr to https://aeda.apps.gov.gr.

To date – and for 3 months that the digital platform is open – 4,000 applications have been filed and only 100 of them have advanced to a next stage.

The basic condition of the right to apply for redemption is the exercise by the applicant himself or the lawmakers, on public property, constantly possession:

(a) for at least 30 years with a title,

(b) For at least 40 years without a title, as long as the applicant uses the property as his main residence or as an auxiliary space of it or to practice tourist, craft, industrial, commercial or agricultural activity,

(c) The declaration of the property in the “E9” form for at least 5 years preceding the application, in order to make it clear that the applicants considered that the property was their own.

How the redemption price is formed

It is recalled that the adoption of Law 5113/2024 also provides that:

• Application can also be submitted for real estate that has no building.

• A ten -day deadline is set to inform the applicant in the event of a lack of supporting documents.
The requirement for aerial photographs is no longer valid as the existence or non -building is no longer examined.

• The State is extended to decide the exemption from the right to redeem for public interest. The relevant Ministries will reasonably determine the areas or properties that must be excluded from the acquisition process.

• The deadline for submitting the consent of the State Real Estate Company in 2 months from 3 months is expedited.
The price of the acquisition is calculated on the basis of the objective values ​​of real estate and social criteria (for vulnerable groups, multiple children, people with disabilities).
In addition, the redemption price in special cases of public property in question is deducted:

• 50% for applicants recognized by a first instance court as the owner of the property or who has been listed as the main in the first cadastral registrations and a lawsuit has been lodged by the State or the deadline for lodging a lawsuit has not expired.

• 70% if the applicant has an appeal against a judicial decision to recognize the ownership of the property by 31.12.2022.

• Special forecast is available for property that covers the housing needs of the applicant or the original lawyer as a result of mass installation of population groups before 1964. In this case the price corresponds to 20% of the fair value of the property

Since the price is paid lump sum there is a 10%discount. It can still be repaid in up to 60 interest -free monthly installments with a minimum dose of 100 euros.

In order to apply to the platform, interested parties must pay a fee of 300 euros.

This amount is either offset by the redemption price or is refunded if the application is rejected.
