In the major plenary session of the Council of State, seven cases of Bar Associations and other scientific and professional bodies were discussed against the decision of the AADE Governor, which determines the process of challenging the minimum annual income from business, that is, the taxation of business.

The contested decision was issued under the Income Tax Code, which introduced a system of imputed to determine the minimum net income from individual business.

Rapporteurs in all cases were Konstantina Lazarakis and Vasiliki Moschou.

In particular, the lawyers of freelancers during the hearing, among other things, pointed out that the tax law is opposed to the Constitution and the ECHR and violates the rule of law, which brings lawyers, etc., etc.

The lawyers of freelance professionals also reported that the tax law brings disproportionate negative treatment on low incomes and strongly affects young lawyers.

At the same time, it was reported that there was disproportionate treatment between employees and freelancers, and elsewhere it was reported that 190 law firms were set up, most of whom are family -friendly to avoid the new tax law, as companies recognize losses, etc.

State lawyers defended the correctness of the tax law, stressing that it serves supreme reasons for public interest and aiming to combat tax evasion, which is a requirement of society. In addition, public lawyers said that a similar tax measure was also existed in 1986 and were extensively referred to the CoE’s case -law on tax measures.

Subsequently, the members of the Plenary of the Council of State asked questions to the 15 lawyers. Specifically, Mr. Pikranos, two vice -presidents, seven consultants and a parody, asked a large number of clarification questions to both sides.

The court reserved to issue its rulings.

In the meantime, a gathering outside the CoE was made by freelancers, scientists, traders and professionals, etc. The rally was organized by the Coordinating Committee for Free Professionals – Scientists – Professors and Merchants, while the Athens Bar Association has declared a universal abstinence of Athens lawyers from their duties.

At the same time, the lawyers of Athens and Piraeus were abstaining following decisions by the Board of Directors of the Athens and Piraeus Bar Association.
