SA Panel: Bayer contests decision preventing bid for hemophilia drug

Bayer’s pharmaceutical division went to the STJ (Superior Court of Justice) to try to reverse a decision by the Pernambuco Court that blocked a bid for the purchase of hemophilia A drugs.

The refusal was based on the PDP (productive development partnership) in force between the Ministry of Health, Hemobrás and the Japanese pharmaceutical company Takeda, in an agreement in which the government must buy, without bidding, an annual volume of the drug, regardless of demand.

The company asks that the competence of the 24th Federal Court of the Judiciary Section of São Paulo be recognized so that the Ministry of Health makes the bidding and any company participates.

Bayer argues that the bidding would increase competitiveness and treatment options.

The STJ states that the lawsuit filed by the pharmaceutical company has requested an injunction and was distributed this Thursday (31) to Minister Sérgio Kukina. The decision should come out in the next few days.
