The Chamber approved this Thursday (7th) a bill that expands the income tax deduction for individuals and companies that sponsor or make donations to sports projects and that extends the Sports Incentive Law until the end of 2027.
The text was approved in a symbolic vote and now goes to the Senate.
The bill amends the Sports Incentive Law and extends for another five years the income tax deduction of amounts spent on sponsorship or donations made to sports or parasports projects authorized by the Ministry of Citizenship.
The bill, reported by Deputy Luiz Lima (PL-RJ), increases from 1% to 2% the deduction that can be made by legal entities. The text, however, prohibits taxed companies from deducting these amounts to determine actual, presumed and/or CSLL (Social Contribution on Net Income) calculation basis.
The proposal allows the limit to be increased to 4% when a sports or para-sport project aims to promote social inclusion through sports, especially in needy communities.
In the case of individuals, the deduction increases from 6% to 7% of the tax due on the annual adjustment statement.
According to the text, the maximum value of the deductions provided will be determined annually by the Executive, based on a percentage of the taxable income of individuals and the IR due by companies.
In addition, the Executive, in order to comply with the Fiscal Responsibility Law, must estimate the value of the tax waiver resulting from the law. The government must demonstrate that the waiver has been considered in the budget law’s revenue estimate and will not affect fiscal outcome targets.
If passed, the law takes effect on January 1 of the calendar year following publication.
The rapporteur defended the proposal. “In clubs such as Flamengo, Corinthians, Minas Tênis, Pinheiros, Grêmio Náutico União, clubs in the Federal District, North, Northeast, Midwest, only 90% of Olympic athletes are maintained due to the Sports Incentive Law , which includes sporting events, training, which makes it possible for professionals in physical education, physiotherapy, medicine, professionals from different areas to have jobs”, he said.
