Panel SA: Procon-SP raises discussion on the proportion of fines

Guilherme Farid, executive director of Procon-SP, says he is working on two main points to discuss at the National Consumer Protection Council, based on conversations he has had with procons in other states.

The discussion about the dosage of fines imposed by defense entities was the subject of the big event of supermarkets attended by Bolsonaro this week and is the subject of a bill in progress in the Chamber.

According to Farid, there is, in fact, a concern with proportionality in the application of fines to small establishments. “The discussion is trying to find a balance between the fine for a bakery or a grocery store and the fine for a big tech,” he says.

The conclusion of the debate that involves other bodies and sectoral representatives should encourage a proposal to be sent to Congress, according to Farid.

He says that one of the points to be discussed is whether the fine should fall on gross or net sales. The other debate is whether the amount to be applied must respect the scope of the company’s revenue according to the administrative body. That is, if the procon is municipal, but the company operates in several states, the discussion is whether the fine should have a local limit or whether it is more appropriate to calculate it by global revenue.

“What we need to see is what is the best public policy to bring stability in job creation and competition for the direct consumer”, says the director of Procon-SP.
