Amber Heard, 36, claims a wrong juror appeared in the defamation trial she lost to ex-husband Johnny Depp, 58, and is seeking an annulment, according to People. In the request made to justice this Friday (8), the defense of the actress says that the person was not summoned for service on the jury and, based on that, Heard is entitled to annulment.
The documents state that the person who was selected for the jury was 77 at the time and had the same surname and address as a 52-year-old who served as a juror for six weeks. Fairfax County selected jurors are registered voters in the area and details such as their names, birthdays and address are included in the voter registration information.
“It is deeply troubling for an individual not called up to jury service, nevertheless, to appear for jury service and serve, especially on a jury like this,” the document says, noting the “high-profile” status of the trial “where the fact and date of the jury trial were widely publicized before and after the issuance of the jury subpoenas.”
The actress’ defense says she hasn’t received proper “due process”, so she’s asking for an annulment “and a retrial”. The request comes shortly after Heard’s lawyer asked for the verdict to be thrown out entirely on the grounds that it was not supported by sufficient evidence.
Contacted by People, Depp’s representative declined to comment on the request for a mistrial.
