TSE orders the deletion of publication by the Latin singer about Lula for fake news

The TSE (Superior Electoral Court) determined the exclusion of a publication by Roberto de Souza Rocha, better known as Latino, 49. The singer had reproduced on Twitter a fake news that insinuated that girls and boys would go to the same bathroom in schools if the ex -President Lula (PT) is elected in the elections on the 30th.

President of the court, Minister Alexandre de Moraes was the one who ordered the publication to be deleted, in view of a representation made by the lawyers of the Brasil da Esperança coalition, which includes the PV and PC do B, in addition to the PT. It was also asked to exclude an excerpt from the live that President Jair Bolsonaro (PL) did on the 16th, in which he also cites the false information.

In the excerpt of the video, hosted on YouTube, Bolsonaro also states that Lula and the PT would be in favor of drug liberation and abortion. In his decision, Moraes wrote that the news “detaches itself from reality, through untruths”.

“It is the dissemination of untrue information tending to misinform the population about issues that are sensitive to the population, which require extensive discussion, and on which, it intends to win over the electorate against such controversial matters, to the evident detriment of its opponent, including with the check carried out demonstrating the falsity of the information”, he evaluated.

He gave the platforms 24 hours to withdraw the publications, under penalty of a fine of R$20,000 per day of delay. Twitter has already complied with the decision. On YouTube, it is still possible to watch Bolsonaro’s live in full until this Friday afternoon (21).

The minister also stipulated a fine of R$100,000 if Latino and Bolsonaro again propagate fake news, either on social networks or in public service concessionaires, such as radio and television. The decision was signed on Wednesday (19).
