Actor Marcos Pitombo, 40, who had already won the lawsuit against influencer Erlan Martins dos Santos, will receive R$ 10,000 more in compensation. Erlan must pay a total of BRL 25,000 for the dissemination of fake news on the Gato Intruso profile, on Instagram, and on a YouTube channel.
According to the actor’s lawyer, Mariana Zonenschein, the victory of the trial that took place this Wednesday (7) was precisely to increase the compensation owed to Pitombo. “In the decision, it was highlighted that the fact that the person is a public figure does not authorize the communicator or influencer to publish any untrue and poorly ascertained fact.”
The decision was taken by the 3rd Civil Chamber of the Court of Justice of Rio de Janeiro, which also determined that the convict will have to pay attorney fees and will no longer be able to speak about the subject. Last year, Erlan posted videos and photos saying that Pitombo would have been the pivot of the separation of influencer Gabriela Pugliesi, 37, and Erasmo Viana, 37, with whom he would have an emotional involvement.
At the time, the actor denied the relationship and went to court asking for the rumor to be deleted. For her defense attorney, “the ‘fake news culture’, which irresponsibly reports untruths and causes damage to victims just to obtain clicks and advantages, deserves reprimand as in this case”.
After spreading the fake news about the actor, the defendant published a video days later saying that he received notification from the court and that he became aware of the rumors through the profile Gato Intruso. According to the actor’s defense, Erlan continued talking about the rumor and that Pitombo was hiding his sexual orientation, demonstrating a lack of commitment to journalism.
