Prosecutors in Santa Fe, New Mexico, formally filed the charges against the actor on Tuesday, January 31, 2023. Prosecutors said the actor’s involvement as a producer and as the person who fired the gun weighed in the decision to file charges .
Santa Fe District Attorney Mary Carmack-Altwies filed the charging documents, which name Alec Baldwin and Hannah Gutierrez-Reed, who supervised the guns on the film’s set. Court documents say they deviated from known safety standards.
Halina Hutchins died shortly after being injured during rehearsals at a ranch outside Santa Fe on October 21, 2021. Baldwin was pointing a gun at Hutchins when the gun went off, killing her and injuring director Joel Souza .
The actor has vowed to “fight” the charges, while claiming he never pulled the trigger. It is noted that if convicted, he faces up to five years in prison.
American film industry protocols require assistant directors to check the barrel of each gun on set and inform the crew if it is empty, using the expression “cold gun”. The Colt, however, was full.
Investigators say the actor pulled the gun from its holster, pointed it at Halina Hutchins and fired the gun, which should have been a plastic or replica gun, according to industry standards.

“Mr. Baldwin had no reason to believe there was a real bullet in the gun or anywhere on the movie set,” the statement said. “He relied on the professionals he worked with.”
Prosecutors say the actor, as producer of the movie “Rust,” failed to consider Gutierrez-Reed’s relative inexperience as an uncertified gunsmith in her second film assignment. They claim both skipped a critical gun safety check. Hutchins’ death has already prompted new security precautions in the film industry.
