An aircraft operated by WS Shows, owned by singer Wesley Safadão, had its auction suspended this Monday (12), by the Superior Court of Justice (STJ). According to the decision of Minister Marco Aurélio Bellizze, the jet was acquired within the law, without any restriction. A session that would try to auction the good was scheduled for next Thursday (15).
According to Safadão, he was the victim of the scammer Francisley Valdevino da Silva -known as Sheik of Bitcoins- and the plane is part of a legal dispute between the two. The jet would have been sold as a guarantee of payment for the investment in Silva’s company.
In this second decision, Bellizze states that the judicial disposal of the aircraft “has the power to completely empty the object not only of the special appeal, which is intended to confer suspensive effect, but also of third party embargoes, pending judgment” . In this way, it is concluded that, after the signed contracts, the company proved that it acquired the aircraft free of any restrictions.
“The embargoing party had its preliminary injunction granted to keep it in possession of the aircraft until the definition of the issue posed in the embargoes”, completes the decision of the STJ. Willer Tomaz, a lawyer representing Safadão in the action, believes that the definition “restores justice”, preventing the “hasty” auction of the aircraft.
The model aircraft Cessna C680 Citation Sovereign was manufactured in 2008 and can carry up to 9 passengers, with permission to fly São Paulo to Chile or Colombia, nonstop.
