In a ruling, Judge Michael W. Fitzgerald turned down Swift’s request to dismiss a lawsuit that said she took the lyrics from R&B girl group 3LW’s 2014 song “Playas Gon ‘Play”.
Fitzgerald said there are “some noticeable differences” between the songs, but also “sufficient objective similarities” for the case to go to trial.
“Although the defendants presented a strong final argument to a jury, they did not show that there are no genuine questions of fact that can be tried,” the judge wrote.
A spokeswoman for Swift had no comment. In 2017, their representatives called the songwriters’ claim of copyright infringement “ridiculous” and “nothing more than a stealing of money”.
