The lawsuit that Deolane Bezerra fought against Google came to an end, bringing partial victory to the lawyer. The former Farm will no longer have its name and image linked to the search term “bafuda” in the internet search engine. However, the claimed compensation will not be paid.
Deolane sued Google after participating in the reality show A Fazenda (Record), in 2022, when he became the target of comments from other participants for allegedly bad breath. In the petition, she said that the search tool suggested a picture of her or her name when the term is queried on the site.
The decision of August 23 by the Justice of São Paulo determined that the request must be granted. The sentence read by F5 condemns the company for “not automatically linking the image of the author and the description of her person to the search for the word ‘bafuda’ in its search engine”.
The decision, however, denied the request for compensation for moral damages requested by the lawyer. The document says that “each party will bear the costs and procedural expenses and attorney’s fees”.
Previously, Deolane even had his disassociation request denied by a judge at the TJ in São Paulo, who “did not see any illegality in Google’s conduct”. He also said that Deolane “freely chose to participate in a program with wide exposure of her private life”. On May 17, she filed a new petition reiterating the requests and asked again for an injunction.
