The São Paulo Court challenged the R$50,000 compensation that rapper Marcelo D2 was supposed to pay to former governor João Doria for calling him a “murderer” in 2019. The musician was sued for moral damages and had been sentenced in July 2022.
Now, according to information from the São Paulo Court of Justice, the 36th Civil Court accepted the arguments of D2’s defense about him not having been correctly notified at the time to be able to defend himself. O F5 failed to find Doria’s defense.
In December 2019, the singer was forced to delete three tweets critical of the then governor João Doria (PSDB) related to the deaths in the Paraisópolis favela (southern zone of SP). In one of the posts, D2 stated that Doria had ordered the deaths of nine young people, which occurred during Military Police action. In another tweet, responding to a statement from Doria saying that he regretted the episode, the singer stated: “No regrets, killer.”
A third post stated that “Doria didn’t like that I called him a murderer and tried, in court, to take my post off the air. So here’s a tribute to another Brazilian of the year. Congratulations to those involved!” Then there was a cartoon of Doria with her hands covered in blood.
At the time, Doria went to court with a request that said that “despite the aggravating party being governor of the state of São Paulo, responsible for public security and macro planning for the exercise of police power, it cannot be attributed to him, as holder of of rights and obligations, direct responsibility for the episode.”
In the first instance, D2 won the case, but Doria appealed and the singer ended up convicted.
