YouTuber Antonia Fontenelle had yet another defeat in court in an action against the brothers Luccas and Felipe Neto. In 2020, Fontenelle published on Instagram a video edited with distorted speeches from the influencers, which ended with an accusation of pedophilia and eroticization of minors.
In a decision last Wednesday (20), published first by O Globo and confirmed by F5, Judge Andréa Pachá of the 2nd Private Law Chamber of the Rio Court of Justice dismissed Antonia’s appeal and maintained the compensation of R$50,000 to each of the brothers. When contacted, the influencer’s lawyer did not respond.
According to the judge, Antonia exceeded the right of expression and violated the personality of the defendants, which is subject to compensation. In an excerpt from the document that the F5 had access, she states that the “naturalization of hate speech and the dissemination of lies can lead to the belief that networks are a no man’s land, without rules or limits.”
In May, the 7th Civil Court of Rio had already ordered the presenter to pay compensation. At the time, judge Samuel de Lemos Pereira said that Felipe and Luccas’ statements were taken out of context in a video. “It is inferred from reading the subtitles, which were written by the defendant herself, offenses intended to depreciate the image of the authors, by alluding that the applicants had committed alleged acts of pedophilia.”
On X (formerly Twitter), Felipe Neto did not mention Antonia’s name or the case, but made a mysterious post that may have something to do with the legal victory. “Oh, how delicious the news I just received,” he posted on Wednesday (20).
