Court rejects complaint of sexual harassment at BBB 23

The Court rejected the complaint filed by the Public Ministry of the State of Rio de Janeiro (MPRJ) against singer Guilherme Aparecido Dantas Pinho, MC Guimê, and MMA fighter Antônio Carlos Coelho de Figueiredo Barbosa Júnior, Cara de Sapato, for the crime of sexual harassment against Mexican Dania Mendez during BBB 23. The two were expelled from production.

The decision was released this Tuesday (9), a year after investigations began into the alleged crime that allegedly occurred during one of the Globo reality show parties. The inquiry was opened by the Women’s Assistance Police Station (Deam) of Jacarepaguá and forwarded to the MP. The duo was indicted by the Rio Civil Police for the crime.

In conversation with F5, Cara de Sapato’s defense celebrated the decision. “Justice was served to Antônio Cara de Sapato, who had been suffering a lot from this unfair accusation. There was no act that attributed the crime of sexual harassment to my client”, commented Ricardo Sidi.

“The accusation against Antônio was clearly unreasonable. Both from the perspective of jurisprudence and specialized literature, it was not possible to maintain that he committed the crime of sexual harassment”, replied Cara de Sapato’s other lawyer, Bruno Viana.

In the document, judge Aylton Cardoso Vasconcellos states that the criminal action was initiated prematurely. He also highlights that Mexican Dania, when interviewed, did not confirm that she felt sexually offended, and said that she did not want the defendants to be criminally prosecuted.

MC Guimê’s lawyer was contacted and did not respond. The Court’s decision to reject the complaint still allows the Public Prosecutor’s Office to appeal.
