Presenter and YouTuber Casimiro Miguel was ordered to pay R$10,000 to a participant in a reality show he called “tramp”, in a live broadcast in 2021. The São Paulo court states that Casimiro insulted mechanic Denilson Martins Jales and now must compensate him for moral damages. There is an appeal.
In the live video, Casimiro reacts to an episode of the program Supernanny (SBT) in which Denilson says he became a father at 22 years old, while his partner was 15. “It’s a crime, jail, jail for the bum. It’s not the lack of judgment, no. It’s the prison you missed. Xilindró, bum”, he says.
In the process, the lawyer representing Denilson alleged that “Casimiro uses his popularity to profit, insult and publicly offend the author.” Initially, he had asked for R$51,000 in compensation.
During the process, Casimiro defended himself by saying that his channel is humorous. Furthermore, he stated that he never attributed the crimes of rape or pedophilia to the man and that this interpretation came from the mechanic, who took the comments made out of context.
The presenter also said that he was referring to the fact that the woman was “too young to understand what it would be like to raise a child.” Finally, he stated that the criticism and satire made are part of the exercise of freedom and opinion.
Judge Ricardo Tseng Kuei Hsu, however, decided that Casimiro committed abuse by calling the mechanic a “tramp, a piece of shit and a jerk”.
The judge also ruled that the video must be deleted. On the presenter’s own Youtube channel, it is no longer possible to find the material, but it can be watched on unofficial channels.
