Court sentences socialite to eight years in prison for racism against Bruno Gagliasso’s daughter

Socialite Day McCarthy was sentenced last Wednesday (21) to serve a closed prison sentence of eight years and seven months for racism against Titi Gagliasso, daughter of actors Bruno Gagliasso and Giovanna Ewbank. The decision is subject to appeal. As a result, she will remain free for now.

THE F5 had access to the sentence this Friday (23). The case is being heard in the 1st Criminal Court of the Federal Court of Rio de Janeiro. The judge states that Day not only offended a then child, who did nothing to her, but also incited other people to commit racism against the little girl for several days.

Furthermore, the judge stated that Day also attacked the entire family, which constitutes clear persecution. The socialite said, without evidence, that Bruno Gagliasso is involved in “money laundering” and that Giovanna is associated with drug trafficking.

“The materiality of the crime in question does not require further digressions, as the words directed at the victim clearly intended to offend her dignity, using explicit references to her race and color,” says part of the decision.

Day MacCartney is currently free. She does not live in Brazil and resides in Canada. If the decision is upheld, the Brazilian courts will have to request her extradition to Canada. There is an agreement between the two countries for cases of this type. The conviction is the most severe punishment for racism in Brazil’s criminal history.

Early in the afternoon of this Friday (23), Bruno and Giovanna confirmed the conviction and celebrated the victory. According to them, the judge’s decision was exemplary and both hope that the judicial understanding will be met as soon as possible.

“Even with all our privileges, the road was long: only in May 2021 were we able to file a complaint. And only last Wednesday, August 21, 2024, seven years later, the Federal Court of Rio de Janeiro issued an unprecedented decision convicting the perpetrator of the crimes for racial injury and racism. The sentence? 8 years and 9 months in prison in a closed regime”, says the artists’ note.

“This is the first time that, in response to racism, Brazil has sentenced a person to a closed prison regime. Yes, it is 2024 and this is still the first time. Although it is late, it is historic. Criminal law says that little can be done to reverse the sentence, at most it can be reduced. And so we hope and will continue to trust in justice, because we have been fighting for years to understand that this victory is not ours, but our daughter’s, collectively and for an entire community”, concluded Bruno and Giovanna.

THE F5 tried to contact Day McCarthy via social media this Friday (23), but had not received a response until the last update of the report.
