Presenter and candidate for Mayor of São Paulo José Luiz Datena (PSDB) is being sued for moral damages by fellow candidate Pablo Marçal (PRTB). The former coach asks for R$100,000 in court after being attacked during the TV Cultura debate with a chair. The petition was filed last Thursday (26).
In the action, Paulo Hamilton Siqueira, the legal coordinator of Marçal’s campaign, states that the “public embarrassment” caused “devastating effects” on the candidate’s physical, psychological and moral spheres, which would have affected his image.
At the time, Datena said she did not regret the act. The action was taken after Marçal raised a complaint of sexual harassment against the presenter of Brasil Urgente (Band).
The journalist responded that the case had not been confirmed by the police and ended up being archived by the courts. He also said that the incident affected his family and led to the death of his mother-in-law.
Afterwards, Marçal stated that Datena was not a man to hit him. That’s when a chair caused turmoil in the debate. Datena ended up expelled, and Marçal went by ambulance to a hospital.
DATENA’S REPLY
According to Eduardo Leite, Datena’s lawyer, his team filed 12 lawsuits in court, including criminal representations, rights of reply and requests for the removal of offensive posts in recent weeks, and that all decisions by the electoral judiciary would have been favorable.
Furthermore, the lawyer states that in the next few days another million-dollar lawsuit for moral damages will be filed based on the offenses committed against the presenter. “Marçal acted with extreme cruelty against Datena’s dignity, since the accusations were lies. The harassment case was unfounded in the labor courts, and in the criminal sphere it was filed without any evidence”, says Leite.
The lawyer also comments that civil lawsuits for moral damages will be suspended until the final decision is reached with the final judgment of criminal cases involving bodily injury, slanderous reporting and defamation.
“In this way, we consider that given the facts and the measures taken, we hope that the Electoral and Common Courts will continue to respond quickly.”
