Understand how is the citizenship of Ludmilla’s daughter, born in the USA

Born in Florida on Wednesday (14), Baby Zuri, daughter of Ludmilla and Brunna Gonçalves, is an American citizen.

Even daughter of Brazilians who do not live in the country, the child is supported by a clause of the 14th American Constitutional Amendment, which guarantees the right to automatic citizenship by birth, regardless of parental immigration status.

In February this year, Donald Trump tried to restrict automatic citizenship by the right of birth. On his first day back to the White House, the US President signed a decree by instructing the notary’s offices to refuse to recognize the citizenship of children born in the American territory if they were daughters of immigrant parents.

The courts of some states, however, barred Trump’s decree claiming that he violates the 14th amendment.

Zuri will still be entitled to be a Brazilian citizen, as soon as the family returns to the country. In this way, the baby will have double citizenship. For now, the couple and the newborn are living in their apartment in Miami.

According to the Ministry of Foreign Affairs, “the Brazilian birth certificate of son of a Brazilian citizen [ambos os pais ou apenas um deles] Born abroad can be done on a Brazilian consulate abroad or at a first office of civil registry office in Brazil “.
