The 6th Chamber of Private Law of the Rio de Janeiro Court of Justice upheld Antonia Fontenelle for moral damages to actress Klara Castanho. The decision obliges the influencer to pay $ 50,000 for moral damages, in addition to maintaining a fine of $ 1.6 million for non -compliance with a court order that determined the removal of an offensive publication.
In 2022, Fontenelle exposed the intimacy of the actress during a live. The host reported the rape suffered by Klara, which resulted in a pregnancy and later delivery of the baby for adoption. Unauthorized disclosure generated a wave of public attacks, causing great suffering to the actress.
Antonia claimed that she only commented on a public knowledge and did not mention the name of the young woman. However, the court understood that it exceeded the limits of freedom of expression, using an offensive speech to harm Klara Brown. According to columnist Ancelmo Gois, from O Globo, in the action the judge points out that, even without mentioning the name, the netizens identified the actress, which caused moral damages.
THE F5 contacted Antonia Fontenelle, but got no response. Klara Castanho’s staff said the actress will not comment on the decision.
