Daughter of the pilot of Marilia Mendonça’s plane wants to sue Cemig for an accident

Vitória Medeiros, daughter of pilot Geraldo Martins de Medeiros Júnior, who commanded Marilia Mendonça’s plane that crashed in the interior of Minas Gerais on November 5, wants to sue Cemig (Minas Gerais energy distribution company) for the plane accident.

The twin-engine hit a cable in the electricity distribution tower in the region, which was confirmed by the company itself.

In addition to Marilia and the pilot, the other three people who were on the flight died in the disaster: producer Henrique Ribeiro, the singer’s uncle, Abicieli Silveira Dias Filho, and co-pilot Tarcísio Pessoa Viana.

“The basic point of the story is that there would be no accident if there were no such high voltage line in the final stretch of the aerodrome, or if it were signposted”, says lawyer Sérgio Alonso, representative of the pilot’s daughter and a specialist in aeronautical law.

Cemig states, in a note, that the distribution line reached by the aircraft “is outside the protection zone of the Caratinga Aerodrome, pursuant to a specific Ordinance of the Department of Airspace Control (DECEA), of the Brazilian Aeronautics Command.”

But the lawyer counters that the risk of accident is created by Cemig and, therefore, it should be held responsible for not having signaled the location, as incorporated by the Civil Code after jurisprudence.

“Even if the wire is outside this protection zone, the obstacle is made by Cemig. The Civil Code, in its article 927, says that anyone who explores dangerous activities, such as nuclear energy, electricity, fuel and others, has an obligation to indemnify for the risks caused. This is the theory of the created risk. You have a dangerous activity, so, whatever happens there, you are responsible”, explains Alonso.

According to him, Vitória’s intention with the action is to repair the memory of her father, who has been attacked by internet users on social networks. He also states that one of the objectives is for Cenipa (Air Accident Investigation and Prevention Center) to recommend that the network at the site be signaled so that other accidents do not occur.

“This high-voltage wire must be signaled, yes, because it is a risk created by the company, and the pilot cannot see a wire without the proper signaling”, reaffirms the lawyer.

Cemig reiterates, in a note, that “it strictly follows the Brazilian Technical Norms and the regulations in force in all its projects.”

“Signaling through orange spheres is required for towers in specific situations, including being within an aerodrome protection zone, which is not the case for the tower that had its cable hit”, he informs.

“The Company once again regrets this tragic accident and sympathizes with the victims’ relatives and friends”, concludes the company.
