(News Bulletin 247) – The European Commission announces that it has opened an in-depth investigation to assess the plan to create a joint venture by Orange and MasMovil.
Indeed, the Commission is concerned that the transaction will reduce competition in the retail supply of mobile and fixed broadband services, as well as multiple-play bundles in Spain.
Orange and MasMovil are respectively the second and fourth largest operators in the retail and wholesale fixed broadband and mobile services markets in Spain.
It appears from the preliminary investigation that Orange and MasMovil are close competitors in the Spanish markets for the retail supply of: (i) mobile telecommunications services; (ii) fixed broadband access services; and iii) multiple-play bundles.
Consequently, the Commission will now carry out an in-depth investigation into the effects of the proposed transaction, in order to determine whether its initial concerns for competition are confirmed. The opening of an in-depth investigation does not prejudge the outcome of the procedure.
