Terror in a cemetery in Kos: 55-year-old convicted of attempted rape

7 years imprisonment imposed by the Mixed Jury Court of Rhodes by a decision taken by a majority (3 members of the composition of the court voted to impose an 8-year prison sentence) to a 55-year-old citizen found guilty of attempted rape.

The court rejected the request for recognition of mitigation and the request for suspension of the sentence.

The 55-year-old resident of Kos, was found guilty of the fact that on January 17, 2019 at 14:30 and on January 21, 2019 at 14:00, in the cemetery of Kos, active with intent, and having decided to commit the crime of rape , began the execution of his criminal act, which both times was not completed for reasons beyond his control.

Specifically, on January 17, 2019 at 14:30 in the above place, he tried to force the victim to tolerate a sexual act.

After hugging her, he pushed her into a field next to the cemetery, threw her to the ground, grabbed her chest, licked her neck and chest, pulled her by the hair and tried to undress her in order to force her into intercourse, while she she resisted all the time, pushed him away with her hands and shouted. The execution of his crime was not completed because a third person appeared and was forced to flee.

Further, on January 21, 2019 at 14:00, in the same place, while the victim was leaving the cemetery, he approached her, pulled her by the arms, pushed her towards his van and tried to put her in it with the obvious purpose of complete what he had left in the middle the previous time, that is, to force her to tolerate sexual intercourse.

The execution of his crime was not completed because the victim raised his voice, with the result that a third person appeared and was forced to release her.

It is noted that has been charged with rape in the pastfor whom he was irrevocably acquitted in the first instance with the June 3, 2013 decision of the Mixed Jury Court of Rhodes, while claiming that he is innocent.

In particular, he apologized that he had not tried to rape the alleged victim and that he had kissed her, that she had processed the complaint because he found out that he had an affair with a Bulgarian national and was jealous and further that the first prosecution witness had approached his employer and asked him to paid 3,000 euros not to testify against him, an amount that he reduced to 1000 euros in a meeting he had with him in the second year.
